EMBARK BLACK LLC — TRAVEL TERMS & CONDITIONS

PLEASE READ CAREFULLY BEFORE BOOKING YOUR TRIP WITH EMBARK BLACK LLC


These Terms & Conditions apply to any trip booked with Embark Black LLC (“Embark Black,” “EB,” “we,” “us,” “our”). By booking a trip with EB, you (“Traveler,” “you,” “your”) acknowledge that you:


(i) are 21 years of age or older
(ii) have read, understand, and accept these Terms & Conditions (“Terms”)
(iii) are entering into a binding contractual relationship with EB


Traveler acknowledges that they have reviewed the trip description, itinerary overview, inclusions, exclusions, and travel requirements prior to booking. Traveler understands the nature of the Experience and confirms that they are booking voluntarily with full knowledge of the trip details as presented by Embark Black.


By submitting any deposit or payment, Traveler confirms acceptance of these Terms & Conditions, including the cancellation policy, refund policy, and travel insurance requirement.

1) PRICING, DEPOSITS, INVOICING & FINAL PAYMENT


1.1 Pricing

Trip prices are as posted on the EB website at the time of booking and do not include airfare unless explicitly stated in writing.

Trips are priced per person based on shared occupancy (double occupancy unless otherwise stated). Single rooms may be available at an additional cost where offered.

Prices may change prior to booking without notice. Once you book, your price is locked in unless your booking is modified (for example: room upgrades, add-ons, or traveler-requested changes).


1.2 Deposit

A deposit is required to reserve your space. For payment plans, the deposit is typically equal to the first installment or another amount determined by EB.


Deposits are generally non-refundable except as provided in the 48-Hour Courtesy Cancellation Window described in Section 3.3 below.


After the 48-Hour Courtesy Cancellation Window has passed, all deposits are non-refundable. Deposits secure accommodations, vendor reservations, and administrative planning costs and are not eligible for refund except where required by applicable law.


Limited Transfer Option (Deposit Only)


If EB receives written cancellation at least 90 days prior to departure, the deposit may be applied as a credit toward another Embark Black tour departing within 12 months, subject to availability and EB approval.


Deposits are not transferable to another person.


1.3 Payment Plans & Authorization

If a Traveler selects a payment plan, Traveler authorizes EB (or EB’s payment processor/platform) to charge scheduled payments as agreed.


Traveler is responsible for maintaining valid payment information and updating EB if a payment method changes.


1.4 Final Payment Deadline

Traveler agrees to satisfy the balance in full no later than 60 days prior to the Date of Arrival (“Final Payment Deadline”).


If the balance is not paid by the Final Payment Deadline, EB may assess a reasonable late fee and/or cancel the booking as described below.


1.5 Missed Payments / Default

If a scheduled payment is declined or not received:

• EB will notify Traveler via email
• If the past-due payment is not resolved within 3 days, EB may assess a reasonable late fee
• If payment is not resolved within 7 days, EB may cancel the booking


Failure to make scheduled payments may result in automatic cancellation and forfeiture of payments made in accordance with the Cancellation Policy.


1.6 Cancellation for Non-Payment

If payment is not submitted in full by 30 days prior to the Date of Arrival, EB reserves the right to cancel the booking and retain funds paid as permitted under these Terms.


2) CREDIT CARD PROCESSING

EB uses third-party processors/platforms to accept payments.

Traveler agrees to update EB if a credit/debit card or bank account becomes inactive or expires.

3) CANCELLATIONS, REFUNDS & DISRUPTIONS

EB coordinates accommodations, activities, and transportation months in advance. Many vendors require non-refundable payments.


3.1 All Cancellations Must Be in Writing

All cancellations must be submitted to:

travel@EmbarkBlack.com


The effective cancellation date is the date EB receives written notice.


3.2 Cancellation & Refund Schedule

Deposits are non-refundable.


Refund eligibility beyond the deposit is determined as follows:


120+ days before departure
Payments refundable minus deposit and processing fees.

90–119 days before departure
50% of total payments refundable (deposit non-refundable). Remaining portion may be issued as travel credit at EB’s discretion.

60–89 days before departure
No refunds. EB may offer up to 50% travel credit depending on vendor commitments.

Less than 60 days before departure


No refunds or credits. EB reserves the right to retain 100% of funds paid.

Refunds may take up to 30 days to process.


3.3 48-Hour Courtesy Cancellation Window

Travelers may cancel within 48 hours of booking and receive a refund of payments made minus processing fees provided the departure date is more than 90 days away at the time of booking.

After this window closes, deposits become non-refundable.


3.4 No Refunds After the Experience

No refunds are provided after the Experience has begun or concluded.


3.5 Chargebacks & Payment Disputes

Traveler agrees not to file payment disputes or chargebacks in violation of these Terms.


If a chargeback is filed in violation of these Terms, Traveler agrees to repay EB for the amount charged back plus related costs including attorney’s fees where permitted by law.


4) TRAVEL INSURANCE (REQUIRED)

Travel insurance is required for all EB trips.


Coverage should include:

• trip cancellation/interruption
• medical coverage
• flight delays
• emergency evacuation


Travel insurance is the Traveler’s primary financial protection in the event of trip cancellation, interruption, illness, injury, travel delays, or other unforeseen circumstances. 


EB strongly recommends purchasing insurance within 14 days of booking.

Proof of insurance may be requested.


5) TRAVEL DOCUMENTS

Travelers are responsible for securing valid passports and visas.


EB is not responsible if Traveler is denied boarding or entry due to improper documentation.


6) AIR ARRANGEMENTS

Travelers are responsible for purchasing airline tickets unless stated otherwise.


EB is not responsible for airline delays, cancellations, or missed connections.


Travelers should purchase flights no later than 120 days prior to arrival.


Flight itineraries must be provided to EB two weeks prior to arrival.


7) TRANSPORTATION

EB arranges transportation for itinerary activities and scheduled airport transfers.


Travelers arriving outside group transfer windows must arrange transportation at their own expense.


8) ACCOMMODATIONS

EB provides accommodations during the scheduled Experience.


Travelers are responsible for room charges, damages, minibar charges, and incidentals.


9) FALSE REPRESENTATION

Travelers may not represent themselves as an EB employee or agent to vendors.


10) WHAT’S INCLUDED

Trips may include:

• lodging
• selected meals
• planned excursions
• ground transportation for itinerary activities
• EB Tour Curator presence

Gratuities are not included unless stated.


11) COMMUNICATION

EB communicates through messaging platforms such as WhatsApp.


Travelers must remain in the group chat and monitor messages for schedule updates and safety communications.


12) EXCURSIONS & ITINERARY CHANGES

EB may substitute or reschedule activities when necessary.


Travelers confirm they are medically and physically able to participate in activities.


Travelers must disclose medical conditions that could affect participation.


Missed activities or optional excursions are non-refundable.


No refunds, credits, or substitutions will be provided for unused services, missed activities, or voluntary itinerary changes by the Traveler. 


13) LUGGAGE

Travelers are responsible for their belongings and airline baggage fees.


14) BEHAVIOR & CONDUCT

Embark Black curates small-group cultural travel experiences designed to foster respectful community and cultural engagement.


Travelers agree to participate with cooperation, flexibility, and cultural respect.

EB may remove disruptive travelers without refund.


Travelers acknowledge that group travel requires flexibility and cooperation. Minor itinerary adjustments, schedule changes, or differences in personal expectations do not constitute grounds for refund. 


Embark Black reserves the right, in its sole discretion, to refuse service to any traveler or remove a traveler from a trip if their behavior, actions, or communications are deemed disruptive, unsafe, illegal, or incompatible with the group experience. This right applies both prior to departure and during the Experience. In such cases, no refund will be provided. 


15) ALCOHOL, DRUGS & ILLEGAL ACTIVITIES

Travelers must follow local laws and consume alcohol responsibly.


Illegal activity may result in removal without refund.


16) SOCIAL MEDIA

Travelers may share their experience but agree not to publish disparaging content about EB or other travelers.


17) GUESTS

Only registered travelers may stay in EB accommodations.


18) ROMANTIC RELATIONSHIPS

Travelers may not pursue romantic relationships with EB vendors, partners, or other travelers during the Experience.


19) LIABILITY & ASSUMPTION OF RISK

Traveler assumes all risks associated with travel, activities, and third-party supplier services.


20) LOCAL EMERGENCIES

EB will communicate guidance through the group messaging platform during emergencies.


21) LOCAL RECOMMENDATIONS

EB may recommend local businesses but does not guarantee their services.


22) ELECTRONIC SIGNATURE

Electronic signatures have the same legal effect as handwritten signatures.


23) PHOTOGRAPHY & VIDEOGRAPHY

Traveler grants EB permission to use photos and videos taken during trips for marketing unless otherwise agreed in writing.


24) NO MODIFICATIONS

These Terms may only be modified in writing by an authorized EB representative.


No verbal statements, marketing materials, emails, text messages, or social media posts shall modify these Terms unless confirmed in writing by an authorized Embark Black representative.


25) FORCE MAJEURE

EB may be excused from performance due to events outside its control including natural disasters, political unrest, government restrictions, pandemics, transportation disruptions, or supplier closures.


Payments may be applied toward a future EB Experience when feasible.


26) TRANSFERABILITY

Bookings may not be transferred without EB approval.


27) WARRANTIES

EB does not guarantee specific outcomes.


28) NOT INCLUDED

Trip prices exclude airfare, visas, baggage fees, personal purchases, optional excursions, and other personal expenses unless stated.


29) THIRD-PARTY SUPPLIERS

EB acts as an intermediary arranging services from independent suppliers.


30) LIMITATION OF LIABILITY

EB is not liable for damages caused by third parties, travelers, or events beyond EB’s control.


31) GOVERNING LAW & DISPUTE RESOLUTION

Texas law governs these Terms.


Disputes must first attempt mediation, then binding arbitration in Austin, Texas under AAA rules.


32) EMBARK BLACK ITINERARIES

EB itineraries are proprietary and may not be reproduced or distributed.


33) AMENDMENTS

EB may update these Terms. Travelers should review the most current version before booking.
